Personal Liability Insurance
In Spain

A guest trips on your stairs. Your child breaks something at a friend’s house. Your dog damages someone’s property.

In Spain, you can be held personally liable and be forced to pay for damage or injury, even if it was unintentional.

Many people think they’re already covered.
But unless you have specific civil liability insurance (RC Particular), chances are: you’re not.

What’s Covered and Why It Matters

Personal liability insurance (RC Particular) protects you if you or someone in your household causes damage to others—at home or in everyday life. It covers accidental harm caused by you, your family members, or even your pets, helping you avoid serious financial risk.

This insurance can cover situations such as:

  • Damage caused by your child to someone else’s property
  • Damage spreading to neighbouring properties (fire, water, etc.)
  • Incidents involving your pet in public spaces
  • Accidental damage in rented or holiday properties
  • Injuries to guests inside your home

Frequently Asked Questions

Is personal liability insurance mandatory in Spain?

Not by law — but in many situations, it’s required in practice.
Think rental contracts, school enrolment or visa applications.
Even if no one asks for it, one accident can lead to thousands in personal claims.

What does personal liability insurance cover?

It covers damage or injury caused to third parties — by you, someone in your household, or your pets.
Examples include:

    • Physical injury to others

    • Damage to property (e.g. furniture, electronics, vehicles)

    • Legal defence and compensation if you’re found liable

What is not covered?

Personal liability insurance does not cover:

  • Damage to your own property

  • Injuries to yourself or your family

  • Business-related claims (you need business liability for that)

  • Gross negligence or intentional damage

Does it cover my children or pets?

Yes — most policies cover everyone living in the household, including minor children and pets.
Let us know if you own a dog: civil liability insurance is mandatory for dog owners, and we’ll make sure your policy meets legal requirements.

Is this the same as pet insurance?

No.
Pet insurance may cover medical costs for your animal.
Personal liability insurance covers damage your pet causes to others — like biting someone, or damaging property.

Does it cover rented property or holiday homes?

Yes — many policies cover damage you cause as a tenant or guest.
For example, if you break a window in an Airbnb or flood the apartment below.
Let us know how and where you live — we’ll make sure it’s included.

Does this replace home insurance?

No.
Home insurance typically includes limited liability cover, but it may not be enough — or valid outside your home.
Personal liability insurance is standalone and broader.
We’ll check what you already have and whether it covers what you need.

I already have home or travel insurance — do I still need this?

Some policies include limited liability coverage, but with low limits or narrow conditions.
We’ll review your existing cover for free and tell you if it’s enough.

Can I be personally sued for something my child does?

Yes.
In Spain, parents are responsible for damage caused by their minor children.
Even if it was an accident. Liability insurance covers this risk.

Can I cancel or adjust the policy during the year?

Policies usually run for 12 months. Cancellation is possible up to 30 days before renewal.
If your activity or structure changes during the year, we’ll help adjust the cover accordingly.
